1. WHO WE ARE

1.1 Who Is Providing the Service

You are entering into a contract with NUVIA CARE LIMITED, a company registered under registration number 123445 with its registered address at 13C Milner Square, Shanowen Road, Santry, Dublin, D09 E2YW. NUVIA CARE LIMITED trades as “test4me”.

NUVIA CARE LIMITED may, from time to time, appoint our partner laboratory, Randox Laboratories Limited trading as RCLS, a company registered in Northern Ireland with company number NI015738 and registered office at Ardmore, 55 Diamond Road, Crumlin, Co. Antrim, BT29 4QY, or other third parties, to assist with our engagement and the performance of our contractual obligations.

NUVIA CARE LIMITED warrants that any such appointed partner laboratories or third parties will be bound by and held to the same contractual obligations and accountability as set out in these terms. Collectively, NUVIA CARE LIMITED and any such appointed parties are referred to as “test4me”.

2. OUR ENGAGEMENT

2.1 Service Contract

The service contract between you and test4me pertains specifically to the provision of testing services, which are supplied to you, the customer, in exchange for the price you have paid. In delivering these services, test4me is committed to complying with all applicable laws governing the provision of such services, including, but not limited to, The Consumer Rights Act 2022 (pdf).

3. IMPORTANT POINTS TO NOTE FOR HOME TESTING KITS

3.1 Test4me will include detailed instructions within your Testing Kit.

3.2 It is essential that you use the testing kit strictly in accordance with these instructions. Failure to do so may prevent test4me from processing your sample or providing your results.

3.3 Test4me will exercise reasonable care and expertise when analysing your sample and will uphold these standards throughout all aspects of the service, including dispatch, reporting, and after-sales customer support.

3.4 Depending on the type of service requested, you may be required to supply certain information to test4me:

  • Your name
  • The unique registration number (URN) on your test kit.
  • Your date of birth.
  • Biological sex
  • Your email address (it is very important that this is recorded correctly so that your results are sent to the right email address);
  • Your telephone numbers.
  • The date of your sample collection.
  • Your current address (including postcode/ Eircode).
  • Your name as per passport
  • Your country of residence
  • Your nationality.
  • Your ethnicity.

3.5 Where required by applicable law, results and any personal data may be reported to the relevant Health Authorities.

3.6 This information will be used solely for the purpose of delivering the service to which you have provided consent, in accordance with data protection legislation.

3.7 On rare occasions, test results may be returned as inconclusive, in which case a retest may be necessary. If the inconclusive result is due to an error on the part of test4me, a replacement test will be provided at no additional cost.

4. REFUND POLICY

4.1 You may cancel the contract within 14 days of ordering for a refund, but if services have started, your refund will be reduced to reflect the value already received. 4.2 Refunds are also available under consumer law if test4me does not provide services with reasonable care or on time.

4.3 Attending an appointment ends your right to a refund unless your sample is lost or misprocessed; in such cases, you can choose a refund for the affected test(s) or a new appointment for retesting.

4.4 Test4me can cancel or reschedule appointments but will try to accommodate you.

4.5 Bookings depend on payment and availability; test4me may refuse bookings at its discretion.

4.6 These rights do not affect your statutory or common law rights, including seeking damages for negligence or contract breach.

5. PRIVACY POLICY

5.1 Test4me is committed to handling data protection with great care. We collect data based on two core principles: transparency and minimization. Your personal data will only be processed according to your instructions. Any Personally Identifiable Information will be deleted as soon as reasonably possible after its original purpose has been fulfilled, but always within 30 days. Similarly, any samples provided will be destroyed promptly and used only for purposes to which you have agreed.

5.2 As a test4me customer, we will collect personal data that can identify you as an individual. This policy explains how the relevant test4me company will use, store, and protect your personal data—whether you provide it to us or we obtain it otherwise.

5.3 Unless otherwise specified, this policy describes how test4me manages, stores, and safeguards personal data collected or generated about you, covering both private and public tests.

5.4 You can be confident that test4me complies with your Data Protection Rights, whether under GDPR or other applicable laws, and will not process your information without your explicit consent.

5.5 The personal data we collect or hold about you

We collect personal data as part of our online booking and testing process. Registration is essential for all testing and reporting of results to proceed, and it is essential that you complete these details, and confirm your acceptance of this policy.

The information we collect during registration includes:

  • The unique registration number (URN) on your test kit (it is very important that this is recorded correctly to ensure that your sample is correctly matched to your online registration);
  • Your name
  • Your date of birth
  • Biological sex
  • Your email address
  • Your country / nationality
  • Your telephone number
  • The date your sample was collected
  • Your full home address (including postcode)

5.6 We only collect necessary information. Any third parties involved in providing the service will be subject to the same obligations under this agreement.

5.7 How Do We Use That Information?

We will only use your personal data when the law allows us to. Most commonly, we will use your personal data on one or more of the following grounds:

  • Where we need to perform the contract that we have entered into with you (in the case of Randox Health in respect of private tests).
  • Where it is necessary for our legitimate interests (or those of a third party) and your interests and fundamental rights do not override those interests.
  • Where we need to comply with a legal obligation (such as reporting requirements to A Health Agency or other governing bodies as required bylaw

5.8 If you have arranged a private test through test4me, you may withdraw your consent for data processing at any time by contacting us.

5.9 When we use your personal data that relates to your health, we do so based on your explicit consent, your vital interests, public interest, reasons related to medical diagnosis, or preventative or occupational health purposes.

5.10 Once you have sent your sample to us, please remember to check your email regularly (including junk or spam folders) for any messages with your Report attached. Please note that we are not responsible for the security of the email domains you provide.

5.11 Personal data necessary for our testing (including results) is stored on secure computer systems.

5.12 As a controller or processor of personal data, test4me and its affiliated companies must process your information fairly and lawfully. We will also process your data in accordance with the instructions of the relevant authority and the terms of our contract.

5.13 We collect, use, and share Aggregated Data—which is anonymous and not considered personal data, as it cannot reveal your identity. Your personal data is permanently erased. Test4me owns all generated Aggregated Data and may use it for commercializing diagnostic products or for research and development to improve public health.

5.14 We will not use your personal data for marketing unless you have explicitly opted in to receive marketing communications from us.

6. GOVERNING LAW AND JURISDICTION

6.1 These terms and related disputes will be governed by the laws of the jurisdiction where the contract is made.

7. OTHER LIMITATIONS AND RESTRICTIONS ON THE USE OF SERVICES

7.1 We cannot guarantee that a specific Scientific Consultant or Medical Practitioner will be available at any given time. While we aim to schedule consultations as soon as possible, no specific timeframe is promised. Typically, consultations last 30 minutes.

7.2 Medical Practitioners may sometimes have differing clinical opinions about the same condition or symptoms. As long as these views are reasonable, having more than one opinion does not mean our services are flawed. Test4me is not responsible for the information provided by Medical Practitioners.

7.3 We do not accept abusive or offensive behaviour towards our staff.
